TERMS & CONDITIONS

The owner of the online store www.virgostudio.eu (hereinafter referred to as the “Online Store”) is Ristiku Stuudio OÜ (registry code 14641174), located at Ristiku 21/1, Tallinn, 10611, Estonia.

These Terms & Conditions (“T&Cs”) govern your use of our Website and set out the legal terms and conditions on which we sell any of the products ("Products") listed on our Website to you. By visiting our Website and/or purchasing any of Products from us, you engage in our “Service”, accept these T&Cs and agree that you use our Website at your sole risk. Please read the T&Cs carefully before you submit your order to us.

Any new features or tools which are added to the current Website shall also be subject to these T&Cs. You can review the most current version of the T&Cs at any time on this page. We reserve the right to update, change or replace any part of these T&Cs by posting updates and/or changes to our Website to reflect changes to our business or changes in the law. Where these changes are significant we will e-mail all of our registered users to make sure that they are informed of such changes. However, it is your responsibility to check these T&Cs before each purchase and use of the Website. The T&Cs in force at the date of each Product order will apply. Please note that any changes to these T&Cs will not affect any order you have already placed with us.

Our Website is hosted on Squarespace.com. They provide us with the online e-commerce platform that allows us to sell our products and provide our services to you.

Validity of contract of sale, product and price information

The conditions of sale apply to purchases of goods from the online store.

The prices of the products sold in the online store are indicated next to the products. We offer free shipping in Estonia. For other EU countries and countries outside the EU the shipping cost depends on the location of the client and the shipping method. The shipping cost is displayed when the client places the order.

Product information is provided immediately adjacent to the product in the online store.

Placing an order

Add the desired products to your shopping cart to order them. Fill in all of the required fields and choose the most suitable shipping method (if applicable) to complete the order. The total cost is then displayed on the screen. Please make sure to check and correct any input errors in your order up until the point at which you submit your order to us by clicking on the ‘Pay Now’ button. We accept payment by most major credit cards and PayPal and the payment for all orders must be made on the checkout page.

We will notify you by email no later than within 48 hours to acknowledge receipt of your order. If we are unable to fulfil your order following this acknowledgement, we will contact you by email or telephone advising you of this. We may not accept your order if an item you have ordered is out of stock, if we have identified a product or pricing error or if we are unable to obtain authorisation for your payment. Acceptance of your order is completed when you receive a despatch confirmation email confirming that the items have been shipped to you.

By placing an order through our website for a product, you understand that your order is an offer to purchase the product(s) listed in your order and you agree to engage in a contract with us. The contract enters into force when the amount payable is transferred to the bank account of the online store.

Payment

Please note that all credit/debit cardholders are subject to validation checks and authorisation by the issuer of the card. If the issuer of your payment card refuses to authorise payment to Ristiku Stuudio OÜ we will not be liable for any delay or non-delivery.

Prices and charges will be displayed in Euros. If your debit/credit card is not denominated in Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Your card issuer may apply other international bank charges. Please note that we have no control over this and we cannot predict the amount of these charges. We recommend contacting your issuing bank before placing an order with us if this applies to you. Charges on your bank statement will appear as Ristiku Stuudio OÜ (PAYPAL *RISTIKU OU).

We reserve the right to change the prices and delivery costs at any time, but changes will not affect any orders in respect of which we have already sent you a despatch confirmation.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. You agree to promptly update your account and other information, including your e-mail address and credit card numbers and expiration dates, so that we can complete your transaction and contact you as needed. You expressly agree that we are not responsible for any loss or damage arising from the submission of false or inaccurate information. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of purchases. We will only give your personal information to third parties where the law either requires or allows us to do so.

Shipping

Shipping within Estonia is free. For other EU countries and countries outside the EU the shipping cost depends on the location of the client and the shipping method. The shipping cost is displayed when the client places the order.

All shipments within Estonia generally arrive at the destination specified by the client within 2 business days after the order has been confirmed via email. All shipments in the EU arrive within 2-5 business days. All shipments for the rest of the world arrive within 3-10 business days.

Delivery times are indicated from the day when the order has been confirmed via email by Virgo Studio. Whilst we aim to fulfil all orders within the time scale indicated above, we cannot take responsibility if the delivery time is longer than indicated or if the delivery is delayed due to circumstances out of our control.

Deliveries are made by a trusted courier and take place from Monday to Friday, excluding bank and public holidays, usually within the hours of 8am to 5pm (or normal working week days in the destination country). Please note that the courier will require a signature for the delivery and we are unable to specify an exact time at which the delivery will take place. Deliveries within Europe are made by DPD courier or delivered to parcel pickup points nearest to the recipients’ address. Your order will be delivered to the delivery address you specify when placing the order. Should you be located in a geographically remote area where we are unable to deliver your order, we will notify you about this before your order is accepted. We reserve the right not to deliver to any country that is prohibited by applicable export laws. We have the right to ship goods in up to 10 calendar days in exceptional cases.

Customs duty and customs clearance fee

All international deliveries are subject to inspections by the customs authorities and may be subject to import duties and taxes which are collected when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes.

Returns and cancellation

We truly hope you are happy with your order, but if it isn’t quite so, we are here to help.

You have 14 days to return an item from the date you received it.

  • To be eligible for a refund, your item must be unused and in the same condition that you received it.

  • Your item must be in the original packaging.

  • Your item needs to have the receipt or proof of purchase.

  • If the item arrived damaged, please take photos as soon as you unpack the box and send these to us as a proof that the damage was done due to careless shipping. No need to return such items.

Inform us at contact@virgostudio.eu that you would like to return your item(s). Please quote your order number in the e-mail. We will then send you instructions on how and where to return the item(s).

You will be responsible for covering your own shipping costs for returning your item.

You have the legal right to cancel your order within seven (7) working days from the date of receipt of the goods if you send us a notice of cancellation in writing and return the goods to us in their original, unopened and unused condition. 

Refunds

Once we receive your item, we will inspect it and notify you that we have received your return. If your return is approved, we will immediately initiate a refund to your original method of payment. You will receive the credit within a certain amount of days, depending on your card issuer's policies.

Direct marketing and processing of personal data

The online store only uses the personal data entered by the client (including name, phone number, address, e-mail and bank details) for processing the order and sending goods to the client. The online store forwards personal data to the transport service provider in order to deliver the goods.

The online store sends newsletters and offers to the client's e-mail address only if the client has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.

The client is able to opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

Settlement of disputes

All complaints made by a client about the online store must be emailed to contact@virgostudio.eu.

If the client and the online store are not able to settle the dispute by agreement, the client may contact the Consumer Dispute Committee. You can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a client and the online store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the client.

A client may also turn to the dispute resolution bodies of the European Union.
